| Description: |
A decoy was set up on private land
adjacent to Crown land in the Sprague
District. This area had many
occurrences of shooting off the road
and hunting on private land without
permission.
The decoy was set up approximately 40
yards from the road and directly in
line with the private land no hunting
sign.
The subject vehicle was the second that
stopped and with charges being laid;
all in a span of 15 minutes.
While processing the offence notice Mr.
Isaac Fehr stated that he did not shoot
from inside the vehicle but stepped
out.
The observing officer stated that
Fehr's feet did not exit the vehicle
even though the driver’s door was open.
It was at this time that Fehr
discharged the firearm.
He pleaded guilty with explanation and
was given the full fine of $1074 plus
forfeiture of his 303 British rifle. |
