Item: Conviction Over limit of goldeyes
Description: On May 25, 2005 Selkirk Officers received information from the public that a male subject had caught more than his limit of 10 goldeyes at Lockport. This male subject would catch and keep 10 goldeyes, leave the area and return a short time later. He allegedly repeated this activity 3 or 4 times. An officer attended and conducted a compliance check of the male subject now identified as Timothy KOSTANIUK of St. Andrews. In Timothy KOSTANIUK's possession were 6 goldeyes. KOSTANIUK proceeded to catch and keep 4 more goldeyes thereby bringing his total to 10. He stated to the officer that he was going to continue angling but that he would release anymore goldeyes that he might catch. The officer departed the area but positioned himself so that he could maintain surveillance of KOSTANIUK. Within the next 8 minutes, the officer observed KOSTANIUK catch and keep another 5 goldeyes. Officers approached Timothy KOSTANIUK again; this time informing him that he was being charged for being in possession of more fish than permitted. The officers asked for the location of the goldeyes caught earlier in the day also. Timothy KOSTANIUK led the officers to a residence on Main Street at Lockport. At this location another male subject appeared with a bag containing 10 goldeyes. Timothy KOSTANIUK was charged with being 15 goldeyes over his limit. Timothy KOSTANIUK pleaded not guilty and a trial was set for October 4, 2006. KOSTANIUK did not appear in court for the trial therefore he was convicted ex parte. The specified penalty of $477 was assessed. This was Timothy KOSTANIUK's second conviction for possessing over his limit of fish; the first being in 2003.
