Hunt deer out of season and hunt big game with rim fire rifle |

A Natural Resource Officer from the
Carberry District received information
from a landowner in the Firdale area.
The complainant reported that he had
observed an individual on an All Terrain
Vehicle shoot a deer on his property.
When the complainant approached, the ATV
driver fled down the road on the ATV.
The landowner was able to follow close
enough to obtain the license plate
number of the fleeing ATV. The deer was
left on the side of the road.
The Officer proceeded to the area and
waited near the abandoned deer carcass.
Eventually a vehicle proceeded down the
road past the deer carcass and was
stopped. The lone occupant claimed he
was just on his way to the city. This
was the same person as the registered
owner of the ATV. An inspection of the
vehicle revealed a .17 caliber rim fire
rifle and ammunition. After further
questioning about the deer and the ATV
the suspect admitted to shooting the
deer on private land and
dragging/retrieving it with the ATV, he
was in the process of loading it on the
ATV when the landowner showed up and
that was when he fled the scene.
There was no firearm season for deer at
the time and it is unlawful to hunt big
game with a rim fire firearm therefore
the man was charged for hunting big game
out of season and hunt big game with a
rim fire rifle.
It is also illegal to hunt on private
land without permission of the landowner
and illegal to abandon a big game
animal. The man was issued warnings for
those offences.
He plead guilty November 14, 2008 to the
charges and was fined $190.00 for using
a rim fire rifle to hunt big game and
$620.00 and a two year hunting
suspension for hunting big game out of
season.
