Angling during closed time and too many lines |

| Description: |
A concerned citizen in the Gull Lake
area contacted the TIP Line regarding
two male individuals angling during the
general closure in the South Division.
The information included a description
of the subject vehicle (full size van
with a company logo written on the
sides). Officers attended and observed
the subject vehicle and two male
subjects angling. The officers counted
10 lines in the water. All the lines
were seized. One subject Olehy PREDKO
spoke very good English while the other
Andriy ANDRIYCHUK spoke English with
difficulty. The officers explained the
offences and both subjects did indicate
understanding. The officers explained
that each angler would be charged with
angling during a closed time and fishing
with 5 lines each. PREDKO whose English
was better than his companion quickly
stated that he only had 2 lines in the
water while his partner had 8. His
partner appeared to not know what PREDKO
was saying. None the less, both
subjects were charged with two
violations each.
ANDRIYCHUK pled guilty and was fined the
$204 specified penalty. The Magistrate
indicated that the Court Brief submitted
by the Officer made it very clear that
ANDRIYCHUK should have known that he was
committing the offences.
PREDKO on the other hand received a $102
fine for two many lines as his response
was that friends had gone home and left
their lines in the water. He received a
reprimand for angling during a closed
time stating that he didn't know that
the season was closed.
All angling apparatus were forfeited to
the Crown. |
