On November 17, 2008 at 5:51 p.m.,
Boissevain Natural Resource Officers,
received a call regarding illegal
hunting activity in progress near
Cartwright, MB. The caller reported that
the occupant or occupants of a Blue Ford
truck had a shot a deer with a high
powered rifle from the vehicle off of
Provincial Road 458 at 5:50 p.m. The
legal time to discharge a firearm ends
30 minutes after sunset. Sunset occurred
at 4:55 p.m. making legal shooting time
end at exactly 5:25 p.m. on this day at
this location. RCMP and NROs arrived at
the scene of the shooting to find the
complainant had blocked the approach
into the property. Both occupants were
taken into custody and placed into the
RCMP cruisers. A search of one subject
revealed a red shell holder with five
spent and two live .243 caliber rounds.
A search of the vehicle revealed a
discharged .243 caliber shell in the cup
holder. A further search of the area
uncovered the deer that had been shot
and killed. Upon questioning under the
Charter of Rights and Police Warning,
the accused told officers where to find
the missing firearm. The accused had
driven back some distance and placed the
rifle in the ditch. The rifle was
located and seized. Upon further
questioning, the accused told officers
that he had shot the deer. The suspects
were transported to the Killarney RCMP
detachment and placed in cells.
Later that evening, the accused gave a
sworn statement admitting to shooting
the deer from the vehicle, without a
license and at a prohibited time.
The deer, high power rifle and other
hunting items were seized. These
offences are very serious as they show a
disregard for the safety of other
hunters who may have been legally
hunting, as well as the safety of the
occupants of the vehicle. Hunting
without a license shows a complete
disregard for hunting laws and is
unethical and destructive to populations
and management.
The accused, a young offender was
convicted December 18, 2008 of all three
offences. He received a fine of
$1437.00 and a 3 year suspension of
hunting privileges. |
