Item: Hunt within 300 metres of a build up area in a Provincial Park.
Description: A Boissevain District Natural Resource Officer was conducting a patrol in the Turtle Mountain Provincial Park. Three treaty hunters were found to be in possession of a dead calf moose on the side of the West Main Road. It is illegal to hunt or possess a loaded firearm within 300 meters of the public roads in the park. The internal remains (gut sack) of the moose were located approximately 42 meters from the road. The accused, Mathew Traverse, claimed responsibility for killing the moose within the restricted area. He was subsequently charged for Hunting within 300 meters of an improvement in a provincial park and possessing an illegally taken animal. The moose was seized. All three men were aware of the 300 meter hunting restriction and all the roads into the park are clearly posted with this information. Traverse was fined a total of $1321 for the two offences. Mathew Traverse was issued a written warning for the same offence in 1999. He also has a record of previous Wildlife Act offences. It reads as follow; - 98/10/15; WLA 12(1); Hunt vertebrate animal at night with lights-Convicted - 98/10/15; WLR 351/87 sec2(a); Hunt from provincial road/highway-Convicted - 99/11/11; WLA 34(1)(a); Loaded firearm in a vehicle-Default Conviction - another wildlife related charge was stayed.
