Closed Season Moose and Deer Hunt Costs $13,000

Two Toronto men have been fined a total of $13,000 for hunting, possessing and transporting moose and deer shot during the closed season.


Ihor Pylypchuk pleaded guilty and was fined $5,000 for hunting moose during the closed season and $3,000 for hunting deer during the closed season. In addition to being fined $2,000 for the possession of illegally killed moose and deer, he received a five-year hunting suspension and his firearm was permanently forfeited to the Crown.


Ihor Maksymyshyn pleaded guilty to transporting moose unlawfully hunted and was fined $3,000.


The court heard that on October 3, 2010, a conservation officer attended a house in the Kinmount area where butchered meat was located in the basement of the residence. Further investigation by conservation officers, with the assistance of the canine unit, led to the location of both moose and deer kill sites on the property. Subsequently, two search warrants were executed on residences in the Toronto area. Officers recovered moose meat from the residence of Ihor Maksymyshyn that matched DNA from the kill location identified on the property in Kinmount. A firearm was located in the residence of Ihor Pylypchuk that was forensically examined and matched to a bullet located in the illegal killed moose.


Justice of the Peace Brian Norton heard the case in the Ontario Court of Justice, Minden, on January 5, 2012.

Closed Season Moose and Deer Hunt Costs $13,000

Two Port Dover-based holders of a commercial fishing licence and the captain of a Lake Erie commercial fishing boat have been fined a total of $25,000 for commercial fishing violations.


James and Rhea Mummery, the holders of the commercial fishing licence, pleaded guilty and were each fined $1,000 for fishing in a prohibited area. The court also required any commercial fishing vessel operating under their licence to have a GPS unit installed that is monitored by the Ministry of Natural Resources.


Dale Mummery of Port Dover, captain of the commercial fishing vessel My Boys, pleaded guilty to violating the terms and conditions of his licence. He was fined $15,000 for exceeding his yellow perch quota, $4,000 for submitting daily catch reports with false information on fishing locations, $1,500 for submitting daily catch reports with false information about the amount of fishing gear being used, and $2,500 for fishing in a prohibited area. For one year he must also have a GPS unit monitored by the Ministry of Natural Resources installed in any commercial fishing vessels he operates.


The court heard that on June 17, 2010, a Ministry of Natural Resources conservation officer inspected Dale Mummery's logbook. The inspection revealed that Dale Mummery had submitted daily catch reports containing false information during the 2010 fishing season. When the correct information was obtained, the ministry found that he had exceeded his yellow perch quota in one of the quota zones on his licence by 4,447 kilograms. The logbook also showed that he set gill nets in a prohibited area on multiple occasions.


Justice Gethin Edward heard the case in the Ontario Court of Justice, Simcoe, on December 19, 2011.
